The Agreement

EU Company, from the one side, and the visitor of the Site/ the user/ the buyer/ the player/ the customer (further “you”, “your”), from the other side, conclude the present Terms and Conditions (further “the Agreement”) and agree that the document constitute the Agreement between the parties.

Text of the Agreement is posted on the Site and it is available during registration on the Site, it contains all significant terms of the Agreement and it is our offer to any competent individual, who uses the Site, according to all terms of the Agreement. Text of the Agreement is a public offer according to the law of Estonia.

The proper acceptance of this offer in accordance with the law of Estonia is the consistent implementation by you of the following actions: read terms of the Agreement, register on the Site, put a tick in the checkbox that you accept the terms before making a purchase.

To register in the Site, please, enter your nickname (login), Rockstar ID, email address, and make up a password. Then pass an email verification. Please, remember credentials you’ve entered because you will need them to log in to the Site. Once you are registered, you can view your profile and transaction history, and change the password if needed.

All terms and definitions found in the text of the Agreement are interpreted by the parties in accordance with the laws of Estonia and the rules of interpretation of the relevant terms used in the Internet.

This Site is offered to players of online game Grand Theft Auto (“GTA” in short) who bought and installed the official licensed paid-for game GTA 5, installed the launcher, registered with Rockstar and got a Rockstar ID, selected our game server and registered with the game on our game server. Pirated or “cracked” GTA are not allowed. The Site is available to users who are at least 18 years of age and of legal age to form a binding contract. The Site is designed for users from all over the Globe except restricted countries that are States Sponsors of Terrorism, RU, BY. If your card is issued in the restricted GEO or the IP-address of your device is situated there, please, do not use the Site and do not make purchases (get in-game Dollars) on the Site. By using the Site, you represent and warrant that you meet all of the eligibility requirements. If you do not meet all of these requirements, you must not access or use the Site.

You can send a request to our Customer Support team 24/7 if you have any questions regarding the Site or your purchase. But the team answers during its working hours: Mon-Fri, 10:00-19:00 (Eastern European Time).

The original language of these Terms and Conditions, as well as all other texts throughout the Site, is English. We make a translation in other languages available for convenience only. You can choose the language in the upper right corner of the screen. In case of conflicts between the original English version and any translation, the English version shall prevail.

The Goods and Prices

The Goods. We provide GTA players an opportunity to buy in-game currency that is called “Dollars” on the Site.

In-game currency is the term given for any money used within a game to buy items, tools or unwrap player packs and take other actions. The in-game currency is purchased with real money and there are exchange rates for it. Once the in-game currency balance is topped up, there is no opportunity to convert in-game currency back to real-world money. You cannot cash the in-game currency out, or sell it back. There are no transfers of in-game currency across servers. There is no reimbursement for in-game currency, if, for example, you terminate your access to the server. If you have in-game currency and you don’t want to play any more, you don’t get a real-world refund and your in-game balance remains AS-IS. You can not exchange in-game currency on real-world money and take it away. The purchase is irrevocable. Please, be aware of that.

In-game currency is digital goods by essence. It is neither virtual currency, nor cryptocurrency (crypto asset). It is not a real-world currency issued by a central bank of any country. In-game currency offered on the Site can be used to buy GTA in-game items on our server by GTA players only. “Dollars” enable a player to buy such in-game items as houses, apartments, cars, motorcycles, weapons, clothes, and business for your in-game character. All these items expand the boundaries of the game and provide additional opportunities for the character and more fun for the player. Also, you can transfer “Dollars” to another GTA player on our server in the game. Transfer means to give voluntarily for no money. We do not facilitate “Dollars” trade between players on the server. You cannot top up someone else’s in-game account via the Site as well.

“Dollars” top up an in-game account of a player. The players can check the balance any time.

Exchange rate for “Dollars”. There are exchange rates for “Dollars”. They depend on the real-world currency you spend for purchase. We can change exchange rates without prior notice. The exchange rate is available on the screen when you select currency on the Get Dollars page. For example, the rate is 1 Dollar = 0,001 USD. This means that you spent 1 USD to buy 1000 ”Dollars”.

The Prices. On our Site, to get “Dollars” means to buy digital goods that are in-game currency. The price you pay is the amount of real-world money you spend to make a purchase. It depends on the currency and its exchange rate. For example, if you buy 1000 “Dollars” for euros and the exchange rate is 1 “Dollar” = 0,0009 euros, it means that you pay 0.90 euros and this is the price of the purchase.

Prices are denominated in different currencies. You choose a currency on the Get Dollars page. The price includes all necessary taxes. You do not pay either packaging or delivery costs. The payment gateway which processes payments for the Site charges a 10% processing fee. The fee is not included in the price and is payable additionally. The fee will be deducted from your bank account along with the price. We do not require the player to bear additional expenses on the Site except the price and the processing fee. But please, be aware that the bank-issuer of your card may charge additional fees for online payments. Also if the currency of your card account differs from the currency of the price, a particular exchange rate is applied to the transaction. We do not know the size of the possible additional fees as well as the exchange rate in advance therefore we cannot calculate the exact amount of funds to be withdrawn from your account after you make a purchase on the Site. Please, check the fees of your bank and the currency conversion rules of the International Payment Card Systems by yourself.

The Purchase and Delivery of the Good.

The Purchase. To make a purchase on our Site means to buy in-game currency “Dollars” and automatically get your in-game account balance topped up on the amount of “Dollars” bought. You can top up your in-game account only. You cannot do it for another player on our Site. If you want to top up your account with the “Dollars” on the Site, you need to be registered. Once you are registered, you log in to the Site. To make a purchase, press “Get Dollars”. On the Get Dollars page, you select your character, select currency and put the amount. Minimum and maximum amounts are displayed on the page as well. You choose a payment method and you will be redirected to the payment page from the BazPay payment gateway. If you pay with debit or credit card, you enter your card payment details. If your bank-issuer supports the 3DS program, you will need to enter the 3DS code. If you pay with Google pay or ApplePay, you follow the instructions on the screen. Once the payment is finalized, you will get a payment report on your email address from your registration details. Please, keep the payment report safely for further reference.

Delivery of the Good. Once you have paid for in-game currency, your in-game account balance will be topped up no later than in 24 hours. Usually, it happens within a couple of minutes, but in some cases you need to wait 24 hours if unpredictable disruptions happen. If you made a purchase but did not receive your “Dollars”, you can apply to our Support team. The in-game currency is considered to be delivered once it reflects on the in-game account and becomes available to the player in the GTA.

If you made a purchase, entered your details correctly but have not received your “Dollars” in 24 hours, you can claim to our support team and we will check the delivery and fix the problem or refund it. In this case you will be asked to provide proof of purchase. For this purpose a photo of your card and a transaction report sent to you on email will be sufficient proof.

Payment Policy

Payment Method. You can pay for the purchase by a credit or debit card of either VISA or MasterCard/Maestro online using the payment page of the payment gateway BazPay. Other payment methods are not available.

Currencies. The payment transaction currency is the currency that you choose on the Get Dollars page in the field “Currency”. If your payment card’s currency differs from the currency chosen, currency conversion is made according to the rules of the International Payment Card Systems. The exchange rate is set by the International Payment Card Systems for blocking the relevant amount on the card and by your bank-issuer of the card for debiting funds from your bank account. Also currency exchange may be charged with a fee by your bank. We do not know the currency conversion rate and fee and do not influence it. Please, check it by yourself. We do not charge the currency exchange fee in our favor.

No discrimination notice. We honor all valid VISA and MasterCard/Maestro cards without discrimination when properly presented for payment. We maintain a policy that does not discriminate among customers seeking to make purchases with a card.

We do not require a minimum or maximum transaction amount in order to accept payment with Visa or Mastercard/Maestro card. There are no restrictions on the cardholder’s rights to dispute payment performed by the payment card.

Security. In accordance with the recommendations of Payment Card Industry Security Standards Council, customer card details are protected using encryption. The company - a payment gateway BazPay - is PCI DSS compliant.

Possible additional fees. The price comprises taxes. It does not contain a 10% processing fee charged by the payment gateway. We do not charge you with any additional fees, costs, expenses in our favor.

But your bank-issuer of the card may charge you with additional fees including transaction processing and currency conversion fee according to its tariffs. We do not know them and we are not responsible for those charges. Please, check them with your bank and be aware of them before you make a purchase.

Acceptance of the Terms and Conditions. You need to agree with current terms and conditions of the Agreement before you make a purchase on our Site. Please, put a tick in the relevant checkbox which the Site makes available to you before you proceed your purchase to the payment stage.

Credential-on-file. Credential-on-file transaction is where a cardholder authorizes a merchant to store and subsequently charge a card at a later date, therefore it can be initiated by either the cardholder or the merchant. We do not practice such types of transactions. We do not store your payment information and do not initiate payment transactions.

Return/ Refund/ Cancellation Policy

Return of the Product. Once the “Dollars” are delivered to you, they cannot be returned to us. If you paid for them and they have not been delivered yet, you can request a refund.

Refund. Completed purchases may be canceled up to 24 hours after the purchase ONLY if the “Dollars” has not been delivered to the buyer. You have the right to request a refund, if the purchase is canceled. To get a refund, you must apply to our support team via the contacts indicated in the section Contact us of these Terms and Conditions. You should add a payment report as a proof of purchase that was sent to you to your email and photo of the card. If you paid for the purchase, did not get the product delivered, 24 hours did not lapse after the purchase and you applied to our support team, you will be refunded in full during 30 days after the refund application is submitted. Your bank’s charges are not refundable. 10% processing fee is not refundable too. Please, be aware of the possibility that your bank can set a refund fee. Please, check it for yourself.

You cannot top up someone else’s in-game account. Technically, you cannot submit a wrong character name, because you select the character from the list. Therefore you cannot apply for a refund claiming that it was the wrong character. But if you have a couple of characters on your Rockstar ID and you’ve made the wrong choice, you can transfer “Dollars” to the correct character in the game. Therefore in such cases you cannot be refunded.

Complaint. If you have purchased “Dollars”, have got it delivered but you are not satisfied with the opportunities added with them, you can not request a refund. But you can submit a complaint to our support team. We are trying our best to make you happy with the items that you can buy with in-game currency, therefore we will study your complaint carefully and let you know about the result of our investigation.

Cancellation. You can cancel your purchase at any time during the process of the purchase until the payment is finalized.

You can cancel your paid purchase and get a refund during 24 hours if you have not got the in-game currency delivered.

You can cancel your acceptance of the Agreement if you terminate your registration. To terminate your registration, please, apply to our support team.

Personal Data

We may collect and process personal data of the user. The data collected, purposes and other relevant terms and conditions are indicated in our Privacy Policy. Please, check it before you use the Site.

We guarantee the security of payments when paying by credit or debit card. The payment gateway that provides the service of processing the payment requests complies with PCI DSS requirements for the secure processing of the payer's bank card details.

Terms of Use of the Site

The content of the pages of the Site is for your general information and use only. It is subject to change without notice.

We reserve the right to enhance, modify, alter, suspend or permanently discontinue all or any part of the Site and to restrict or prohibit access to it at any time and without notice. We can change the exchange rate of in-game currency without prior notice.

In the event that any part of these terms contained in the Terms and Conditions shall be determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such term shall to that extent be severed from the remaining terms which shall continue to be valid and enforceable to the fullest extent permitted by law.

These Terms and Conditions shall be governed by and construed in accordance with the laws of Estonia. Any dispute arising out of use of the Site is subject to the laws of Estonia.

Limitation of Liability

We are not responsible for the user's losses due to the unlawful actions of third parties, including unauthorized access to the Site under the user’s registration. We are not responsible for damages caused to the User as a result of disclosure to third parties credentials required for access to the Site not due to the fault of us.

We are not liable if the in-game currency purchased was not delivered to the player due to technical problems on a third party’s side.

Software and hardware errors like from our side and from your side, leading to the inability to obtain the user's access to the Site, are force majeure, and are the basis for exemption from liability from fulfilling obligations according to the Agreement.

Unless another is specified in the Agreement in case of breach of conditions of the Agreement by the user, we may unilaterally refuse to perform the Agreement and to discontinue user's access to the Site. In the event that such a breach has caused damage to third parties, the responsibility for them lies entirely upon the user.
